살아 있는 생물(生物)로 불리는 정치에는 변수가 많아 가상 시나리오가 가능하다. 지난 2024년 12.13 비상계엄 사태로 촉발된 대통령 대행 체제의 종결은 어떻게 진전되는 것일까? 헌법재판소의 판결 결과에 이목에 쏠리고 있다. 시나리오적 시각에서 4가지 변수들을 물색해본다.
1.헌법재판소 윤석열 대통령 탄핵인용?
헌법재판소를 출입하는 법조 기자들에 따르면, 오는 2월 28일 윤석열 대통령의 탄핵인용이 가능할 것이라고 한다. 이게 가능하다면, 헌재 선고 이후 2개월 이내에 대선을 치르게 돼 있다. 이런 스케줄 때문에 4월 29일이 대선일이 될 가능성이 높다고. 이리 되면, 차기 대통령 취임일은 4월 30일. 이 날부터 차기 대통령 임기가 시작된다.
2.이재명 더불어민주당 대표 대선출마 가능할까?
이재명 더불어민주당 대표는 여러 가지의 재판 일정이 기다리고 있다. 차기 대선일이 4월 29일로 확정된다면, 이재명 대표의 대선 출마가 가능할까? 가능성과 불가능성이 항존(恒存)한다. 대통령 선거일 이전에 대법원에서 유죄가 선고된다면, 대선 불출마의의 길을 걷게 돼 있다. 출마자격이 박탈된다. 그러나 헌법 84조에 따라, 그가 대통령에 당선된다면, 대법원의 판결이 어려워 대통령에 당선될 가능성이 높아진다.
3.국민의힘 재집권이냐, 민주당 수권이냐?
윤석열 대통령의 탄핵 인용이 사실로 드러난다면 “국민의힘 재집권이냐, 민주당 수권이냐?”는, 권략의 향배 문제가 뒤따른다. 야당이 국회의 다수 의석을 확보하고 있어, 민주당 수권이 점쳐지기도 한다. 그러나 중도층이 국정운영의 안정을 원한다면, 국민의힘 재집권 구도도 예상된다.

4.대통령 선거 급물살...누가 대통령 후보로 나오나?
차기 대선일이 4월 29일로 확정된다면, 대통령 선거는 급물살을 타게 된다. 진보-보수 장외대결 구도에서 선거운동 체제로 급 변환된다. 이 경우, 여당 후보와 야당 후보로 누가 선출될까?
급작스럽게 치러져야할 대통령 선거이기 때문에, 의외의 인물이 대통령 후보로 진출할 가능성이 높다. 여당의 경우, 서울시장-대구시장 등이 예상 후보로 거론되지만. 현직사퇴 등이 후폭풍으로 예견되어 신중할 것으로 보인다. 야당의 경우 이재명 더불어민주당 대표의 사법 리스크가 최대 변수다. moonilsuk@naver.com

Politics, which is called a living organism, has many variables, so a virtual scenario is possible. How will the end of the acting presidential system triggered by the martial law on December 13, 2024 progress? Attention is focused on the ruling of the Constitutional Court. Let's take a look at the 4 variables from a scenario perspective.
1. Will the Constitutional Court impeach President Yoon Seok-yeol?
According to legal reporters who cover the Constitutional Court, it is possible that President Yoon Seok-yeol will be impeached on February 28. If this is possible, the presidential election will be held within 2 months of the Constitutional Court's ruling. Because of this schedule, there is a high possibility that the presidential election will be held on April 29. If this happens, the next president's inauguration will be on April 30. The next president's term will begin on this day.
2. Is it possible for Lee Jae-myung, the leader of the Democratic Party of Korea, to run for president?
Lee Jae-myung, the leader of the Democratic Party of Korea, has several trial schedules pending. If the next presidential election is confirmed to be April 29, is it possible for Lee Jae-myung to run for president? There is always the possibility and impossibility. If the Supreme Court finds him guilty before the presidential election, he will have to go down the path of not running for president. He will be disqualified from running. However, according to Article 84 of the Constitution, if he is elected president, the Supreme Court’s ruling will be difficult, increasing the possibility that he will be elected president.
3. Will the People Power Party regain power or the Democratic Party take power?
If the impeachment of President Yoon Seok-yeol is proven to be true, the question of “Will the People Power Party regain power or the Democratic Party take power?” will follow. Since the opposition party has secured a majority of seats in the National Assembly, it is predicted that the Democratic Party will take power. However, if the middle class wants stability in state administration, the People Power Party's return to power is also expected.
4. Presidential election is gaining momentum...Who will run as the presidential candidate?
If the next presidential election date is confirmed as April 29, the presidential election will gain momentum. The progressive-conservative confrontation structure will change to an election campaign system. In this case, who will be elected as the ruling party candidate and the opposition party candidate?
Since the presidential election must be held suddenly, there is a high possibility that an unexpected person will run as the presidential candidate. In the case of the ruling party, the mayor of Seoul and the mayor of Daegu are expected as candidates, but they seem to be cautious because they are expecting the aftermath of the resignation of the incumbent.
