브레이크뉴스 정명훈 기자= 헌법재판소는 13일 김건희 여사의 '도이치모터스 의혹 부실수사 논란'으로 탄핵된 이창수 서울중앙지검장 등 검사 3명에 대한 탄핵을 기각했다.
헌재는 이날 오전 심판정에서 이창수 지검장과 조상원 서울중앙지검 제4차장검사, 최재훈 반부패수사2부장검사 탄핵심판에서 재판관 전원일치로 기각을 결정했다.
헌재는 검찰이 윤석열 대통령의 배우자 김건희 여사를 제3의 장소에서 조사한 것이 부당하게 편의를 제공하며 수사 재량권을 남용했다고 볼 수 없으며 도이치모터스 사건 관련해서도 허위사실을 발표했다고 볼 수 없다고 판단했다.
이어 검사 3명이 김건희 여사를 수사함에 있어서 적절히 감독했는지에 대해선 의문이 있으나, 상당기간 이후 수사에 관여했기 때문에 추가 수사 필요성을 판단할 자료가 충분치 않다고 탄핵 사유를 설명했다.
탄핵심판 결정의 효력은 즉시 발효됨에 따라 이들 3명은 98일 만에 직무에 복귀하게 됐다.
앞서 국회는 더불어민주당 주도로 이들 3명에 대해 김 여사 도이치모터스 주가조작 관여 의혹 사건을 부실하게 수사했으며 불기소 처분을 내린 점 등을 문제 삼아 지난해 12월 5일 탄핵안을 가결했다.
한편, 헌재는 이날 최재해 감사원장 탄핵심판 사건에 대해서도 재판관 8인의 만장일치 의견으로 기각 결정했다. 이상민 전 행정안전부 장관(기각 9인 만장일치)과 이진숙 방송통신위원장(기각 4인·파면 4인)도 기각된 바 있다.
