브레이크뉴스 정명훈 기자= 유튜브 등 온라인 플랫폼에서 내란, 폭동, 테러 등을 선동하는 유튜버의 수익 창출을 차단해야 한다는 주장이 제기됐다.
국회 행정안전위원회 양부남 의원(광주 서구을)은 25일, 허위사실 유포나 조작된 정보를 이용해 내란·폭동·테러 등을 선동하는 콘텐츠를 불법정보로 규정하고, 이를 통해 수익을 창출하는 행위를 막는 내용의 '정보통신망 이용촉진 및 정보보호 등에 관한 법률' 일부개정안을 대표 발의했다.
최근 유튜브 등에서 경제적·정치적 이익을 노리고 허위정보나 왜곡된 사실을 퍼뜨려 사회적 혼란을 야기하는 사례가 늘고 있다. 특히, 2024년 12월 3일 계엄 이후, 부정선거 의혹을 조장하며 폭동을 선동한 일부 콘텐츠가 법원 난입 사태까지 촉발시키는 등 헌정질서와 법치주의를 위협했다. 더욱이, 이러한 선동 행위를 통해 일부가 수익을 올리는 문제도 심각한 상황이다.
이에 따라 마련된 개정안은 우선 경제적 또는 정치적 이익을 목적으로 거짓 또는 사실을 왜곡하거나 조작해 정확한 사실관계를 오인하도록 유도하거나 내란, 폭동, 테러 또는 이에 준하는 범죄를 조장하는 내용의 정보를 불법정보로 정의하고, 이러한 불법정보를 유통하는 행위를 금지했다.
또한, 방송통신위원회가 방송통신심의위원회의 심의를 거쳐 해당 불법정보의 유통을 통해 얻은 수익 관련 계좌에 대해 금융회사에 지급정지를 요구할 수 있도록 했다. 불법정보 유통을 통해 얻은 경제적 이익을 차단할 수 있는 근거를 마련한 것이다.
아울러, 불법정보를 유통한 자에 대해서는 1년 이하의 징역 또는 1천만 원 이하의 벌금을 부과하는 등 강력한 처벌 규정을 신설했다.
마지막으로, 불법정보를 통해 발생한 수익은 몰수·추징할 수 있도록 법적 근거를 마련하여, 범죄를 통한 부당이득을 철저히 환수할 수 있도록 했다.
양부남 의원은 “온라인에서 허위정보를 퍼뜨려 내란·폭동·테러를 선동하는 행위는 단순한 여론 조작이 아니라, 헌정질서와 법치주의를 직접적으로 위협하는 심각한 범죄”라며 “사회 혼란을 야기하고 이를 통해 부당한 이익까지 챙기는 행태를 반드시 근절해야 한다”고 강조했다.
