한국의 현대정치사에서 가장 크게 정치보복을 당한 정치인은 김대중 전 대통령이었다. 그는 일본에서 납치 당해, 강제로 귀국하기도 했다. 박정희 정권은 1971년 대선에서 집권한 후 1972년 10월에 유신을 선포했다. 그 후, 중앙정보부는 1973년 8월8일 미국 일본 등에서 유신 반대운동을 주도했던 김대중을 납치했다. 납치는 성공했으나 암살에는 성공하지 못했다. 박정희 정권은 유신을 선포한 직후, 시민 시위가 증가하는 등 정치불안이 증폭되자 이를 제어하기 위해, 김대중 납치사건을 저질렀다. 정치보복이었다. 전두환 정권은 5.18 직후 김대중에게 내란혐의를 씌워 구속-수감했다. 이 역시 정치보복이었다.
그런데 이재명 정권이 출범한 이후 정치보복이라는 말이 서서히 나오기 시작했다. 정치 보복(報復=보복하다=남이 저에게 해를 준 대로 저도 그에게 해를 주다)이란, 보복을 하는 세력과과 당하는 세력 간의 악순환을 의미한다. 정치보복은 또 다시 보복을 부르는 구조(構造)이다.

신평 변호사는 7월 27일 인터넷 저널 페이스북에 “윤석열 전 대통령을 향한 반인권적 탄압에 대하여 미국을 비롯한 서방 국가들의 개입을 촉구하며”라 제목의 글을 게재했다. 이 글 속에 '정치보복'이 무언지에 대한 내용이 담겨 있다.
신평 변호사는 “나(신평 변호사)는 7월 25일 일반인의 접견이 금지된 윤석열 전 대통령에 대한 접견을 변호사라는 이유로 할 수 있었다. 윤석열 전 대통령을 접견실에서 뵙고 이런저런 이야기를 나누었다. 참으로 놀랍고 가슴 아픈 내용을 들었다. 책을 하나 집필하는 것이 좋지 않을까 하고 권해드리니 도저히 그럴 형편이 못 된다고 하였다”면서 “구금된 독방은 불과 1.7 혹은 1.8평밖에 되지 않는 협소한 곳이고, 책상이나 걸상은커녕 방안에 골판지로 만든 허술한 받침대 하나가 놓여있을 뿐이다. 여기 앞에 쭈그리고 앉아 간신히 식사를 하고, 그 위에다 성경책을 놓아 읽는 외에는 어떤 지적 활동도 할 수 없는 처지라고 하였다. 최소한의 운동도 할 수 없어 소화에 문제가 생겨 애를 먹는다는 말씀도 했다. 밤에 자리에 누우면 꼼짝달싹할 수가 없다고 한다”고 썼다.
이어 “그냥 한 마디로 말하면, 처참한 주거환경으로 생지옥(Hell on the Earth)이라고 부를 수 있는 곳이다. 과거 박근혜 대통령이나 이명박 대통령의 경우에 이렇게 심하지는 않았다. 민주당 김병기 원내대표의 '죽어도 감옥에서 죽어야 한다.'는 악담을 현실화시키기에 적합한 곳인지 모른다. 건강상의 이상 징후는 여럿 있으나 그럼에도 이상하리만치 그의 얼굴은 맑은 표정에 아주 평안한 기운이 서려 있었다. 내가 그렇게 말씀을 드리니 그러냐고 하시며 싱긋 웃었다“면서 ”접견을 마치고 나오는데 서러운 감정이 북받쳐 올랐다. 그는 내 손을 잡으며 오늘 대화 내용은 밖에 알려지지 않는 것이 좋겠다고 하였다. 그런데 시간이 지나면 지날수록 속에 열불이 치받혀 그대로 있을 수가 없었다. 도저히 더 참을 수 없어 부득이 그 분의 당부를 무시하고, 어제 저녁 페이스북에 이에 관한 글을 썼다“고 했다.
신평 변호사는 이글의 말미에 “한국헌법학회장을 지낸 헌법학자로서 나는 인권을 역사적으로 소중하게 여겨온 미국이나 서방의 여러 나라에 감히 탄원한다. 지금 한국에서 전직 대통령을 향해 가혹한 정치보복의 일환으로 벌어지는 이와 같은 비정상국가의 어두운 면모를 확인하고, 비문명적이고 야만적인 인권탄압이 중지될 수 있도록 신속하고 적절한 개입을 해줄 것을 간절히 호소한다”고 덧붙였다.
이 글은 윤석열 전 대통령이 구금되어 있는 감옥을 방문하고 돌아온 현직 변호사가 쓸 글이다. 신평 변호사는 이 글에서 “정치보복의 일환”이라고 언급했다. 다시 말하면 정치보복이라는 것이다. 지금은 이재명 정권의 시절이니 “이재명 정권이 정치보복을 하고 있다”로 해석해도 무방(無妨)하다.

한국의 민주주의는 피를 먹고 자랐다. 여야 정권교체라는 위대한 정치 시스템을 구축한, 강한 나라이다. 그런데 이런 나라에서 후진적인 단어인 '정치보복'이라는 말들이 나돌기 시작했다는 것은 좋지 않은 일이다. 정치보복은 또 다시 보복을 부른다. 이재명 정권 초반, 꼭 해결해야할 고뇌이다. 현 정권이 성공하는 정권이 되려면, 이의 해결을 진지하게 고민해 봐야한다.
