이재명 대통령이 지난 8월 비공개 국무회의에서 "독재자가 나타나 나쁜 짓을 하면 시스템이 아무 소용 없다는 건 옳은 얘기로 이 같은 문제를 더 쉽게 초래할 수 있도록 만든 게 검찰 정치화였다"며 "일단 단절해야 한다"고 주장했다.
12일 정부가 공개한 올해 지난 8월 28일 국무회의 회의록에 따르면 이 대통령은 중대범죄수사청(중수청) 수사권 관련 논의 중 이같이 주장 후 "문제는 그 얘기를 국민이 납득할 수 있도록 해야 한다는 것으로 국민이 보는 곳에서 합리적으로 논쟁해야 한다"고 했다.
이 자리에서 중수청을 행정안전부 또는 법무부 산하에 둘지에 대한 논의 중 이 대통령은 "마치 샅바싸움 하듯 법무부냐 행안부냐 논쟁하거나 행안부 산하에 두자 주장하는 사람을 나쁜 사람인 것처럼 얘기하기도 하던데 그럼 안 된다"고 했다.

이어 "그 구조가 단절된 상태서 법무장관이 대통령 국정 철학에 기반해 지휘하는 것"이라며 "그런데 (행안부 산하에 두면) 중수청장으로 이상한 자가 나타나 자기 멋대로 할 경우 통제할 수 있는 사람이 없다"고 주장했다.
조원철 법제처장은 "(현 상황은) 합리적 토론이 되기 어려운 걸로 보인다"며 "법무부 내 검찰 역할을 축소하는 게 선행돼야 한다"고 주장했다.
그러면서 "한 번 검사는 영원한 검사란 말이 있으며 저도 많이 느꼈다"며 "검사들이 법무부를 장악하는 것을 일단 막아야 하며 '법무부 문민화'라 할 수 있는데 법무부에서 검사 역할을 검찰국 정도로 제한해야 한다"고 주장했다.
한편 이날 정 장관이 "(검찰 수사 중) 정치 관련 특수부 사건은 사실 0.1% 정도"라고 말하자 이 대통령은 "그런데 그게 나라를 들쑥날쑥하게 하는 게 문제"라고 했다.
