【브레이크뉴스 포항】박영재 기자=김정재 의원(국민의힘·포항북구)은 26일 영세 자영업자의 경영 안정을 강화하고 지역 상권을 실질적으로 보호하기 위한 ‘소상공인 보호 패키지 3법’을 대표 발의했다고 밝혔다.
이번 패키지는 대기업의 과도한 시장 진출로부터 지역 소상공인을 보호하기 위해 마련된 것으로, 먼저 '소상공인 보호 및 지원법' 개정안(1안)은 지방자치단체가 ‘지역상권보호구역’을 지정·고시할 수 있도록 했다.
해당 구역에서는 대기업의 사업 인수·확장 등 영업 행위를 제한하도록 법적 근거를 부여해, 프랜차이즈 본사와 플랫폼 대기업의 시장 잠식을 제도적으로 차단할 수 있는 장치가 포함됐다.
현행 소상공인 지원 체계가 주로 창업·교육·자금 지원에 머물러 있어 실질적인 ‘상권 보호 기능’이 없다는 현장의 지적을 보완한 조항이다.
패키지 3법 중 두 번째 개정안은 폐업 소상공인의 재기를 지원하는 제도를 기존 권고 수준에서 ‘의무’ 조항으로 강화한 것이 핵심이다.
부채 감소, 채무 조정, 재창업 지원 등 필요한 지원 정보를 정부가 제공하도록 법적 의무를 부여해 실효성을 높였다.
김 의원은 “경영상의 어려움으로 폐업한 소상공인이 다시 일어설 수 있는 체계적 지원이 필요하다”고 강조했다.
마지막으로 '소상공인 생계형 적합업종 지정에 관한 특별법' 개정안은 생계형 업종의 지정 기간을 현행 5년에서 ‘5년 이상’으로 확대했다.
정기적인 재지정 절차가 소상공인에게 불필요한 불안과 행정 부담을 준다는 지적을 반영해 제도의 안정성을 높이려는 취지다.
김정재 의원은 “소상공인은 지역 일자리의 중심이자 우리 경제의 뿌리”라며 “무분별한 대기업 확장과 불안정한 제도로 상권이 무너지는 현실을 더 이상 방치할 수 없다. 이번 패키지 3법을 통해 자영업자가 안심하고 영업할 수 있는 기반을 반드시 마련하겠다”고 말했다.
이번 개정안은 소상공인 단체와 지자체의 관심이 큰 만큼 국회 논의 과정에서도 주목받을 전망이다.
