브레이크뉴스 정명훈 기자= 지난해 서울서부지방법원 난동 당시 법원 청사에 진입해 라이브 방송을 촬영한 혐의로 기소된 유튜버 2명이 1심에서 징역형 선고유예 판결을 받았다.
서울서부지법 형사9단독 김민정 판사는 27일 특수건조물침입 혐의로 기소된 한모(48)씨와 김모(55)씨에게 각각 징역 6개월의 선고를 유예했다. 선고유예는 일정 기간 동안 추가 범죄 없이 지내면 형의 선고 효력이 상실되는 판결이다.
재판부는 피고인들의 행위가 단순 촬영을 넘어 다중의 위력이 형성된 상황에 합세한 침입에 해당한다고 판단했다.
재판부는 “피고인들의 행위는 단순한 현장 촬영에 그친 것이 아니라 다중의 위력이 형성·유지되고 있는 상황에 합세해 그 위력을 현실적으로 강화하는 형태의 침입”이라며 “다중의 위력을 보인 상태에서 법원 경내에 침입한 점이 인정된다”고 밝혔다.
다만 재판부는 피고인들이 법원 시설을 공격하거나 점거하는 등 추가적인 불법 행위에는 가담하지 않았다는 점을 양형에 반영했다.
김민정 판사는 “피고인들이 법원 시설 공격이나 점거를 목적으로 진입한 것은 아니며, 유튜브 라이브 촬영과 현장 기록을 위한 접근 과정에서 경내에 들어가게 된 것으로 보인다”며 “당시 방송에서 경내 진입자들의 행위를 비판하거나 기록으로 남기려는 취지의 발언도 확인된다”고 설명했다.
한편, 이들은 지난해 1월 서울서부지법 난동 당시 법원 청사 내부로 들어가 영장전담 판사 사무실 방향으로 이동하며 라이브 방송을 진행한 혐의로 기소됐다.
