이에 대해 서울시는 2월 23일 국토부의 의견을 존중, 도시관리계획·실시계획 변경 등 국토계획법에 따른 절차를 즉시 보완할 예정이나, 현재 상태에서 공사가 중단될 경우 해빙기와 맞물려 안전사고 발생 우려가 있으며, 이달 21일 유명 가수 공연에 많은 인파가 밀집될 것으로 예상되는 만큼, 공사장 안전 확보를 위한 조치(상판 덮개 시공, 기존 지하 외벽 보강, 배수시설 설치)까지는 이행될 필요가 있다는 의견을 제출했다.
그러나 국토부는 서울시 의견 청취 3회, 현장 점검 2회를 통해 공사중지 명령을 내리기로 결정했다.

국토부 김이탁 1차관은 “도시계획시설은 도시기능을 유지하고 국민생활에 많은 영향을 미치는 중요 공공기반시설”이라며 “도시계획시설을 설치 또는 변경하려면 주민의견수렴, 관계 행정기관협의 등 적법한 도시관리계획 결정(변경) 절차를 따라야 한다”고 전했다.
반면, 서울시는 국토교통부가 서울시의 충분한 설명과 협의 요청에도 불구하고 광화문광장 ‘감사의 정원’ 공사중지 명령을 최종 통지한데 대해 깊은 유감을 표명했다.
서울시는 “지난 달 23일 감사의 정원 조성 사업은 지방자치법에 의거한 서울시의 고유 권한이나 국토계획법 소관 부처인 국토교통부의 의견을 최대한 존중해 국토계획법에서 정한 절차를 즉시 보완하겠다”는 내용의 의견서를 국토부에 회신했다.

김창규 서울시 균형발전본부장은 “이번 공사중지 명령은 유감스러우나, 신속하게 행정절차를 이행해 사업을 정상 추진하겠다”며 “시민의 안전과 광화문광장 감사의 정원의 준공을 위해 최선을 다하겠다”고 말했다.
