정 전 부시장은 지난해 1월, 자신의 SNS에 홍준표 전 대구시장 사진과 함께 ‘준비된 대통령, 검증된 대통령’이라는 문구가 담긴 이미지를 올린 혐의로 기소됐다.
재판부는 “피고인의 게시물이 선거 결과에 영향을 미쳤다고 보기 어렵고, 피고인이 범행을 인정한 점 등을 종합적으로 고려했다”며 검찰의 항소를 기각한 이유를 설명했다.
이로써 정 전 부시장은 1심과 동일하게 벌금 90만 원을 확정받았다. 공직선거법상 벌금 100만 원 이상 확정 시 5년간 피선거권이 제한되지만, 정 전 부시장은 이에 해당하지 않는다.
정 전 부시장은 선고 직후 입장문을 내고 “사법적인 짐은 내려놓았지만, 시민들께 진 빚은 앞으로 일로 갚겠다. 시민들께 감사드린다”고 밝혔다.
