지난 3월12일부터 판사와 검사까지 감옥에 보낼 수 있는 이른바 ‘법왜곡죄’를 포함한 사법 장악 3법이 시행된다. 겉으로는 조용해 보일지 모르지만, 실상은 80년간 유지돼 온 삼권분립의 한 축, 사법체계가 뿌리째 흔들리는 헌정사 초유의 사태이다.
군사독재와 유신독재 시절에도 감히 건드리지 못했던 민주주의의 역린을 결국 건드리고 만 셈이다. 그 폐해는 하루아침에 드러나지 않을 수도 있다. 그러나 서서히, 그리고 묵직한 파괴력으로 우리 사회를 잠식해 들어갈 것이다.
사법을 권력의 도구로 만드는 순간, 민주주의는 껍데기만 남고 국민의 권리는 껍질처럼 벗겨지기 때문이다. 그런데 정작 이 법의 제1의 목적으로 의심받아 온 ‘공소취소 공작’은 시행과 동시에 암초에 부딪혔다. 이른바 ‘공소취소 거래설’이라는 의혹이 불거지며 상황은 오히려 더 복잡해지고 있다.
더 아이러니한 것은 따로 있다. 새로 만든 ‘법왜곡죄’ 자체가 공소취소 행위를 오히려 ‘법 왜곡’으로 판단할 근거가 될 수 있다는 지적이 검찰 내부와 법조계, 심지어 민주당 내부에서까지 나오기 시작했다는 점이다. 방탄을 위해 만든 법이 스스로 방탄을 막는 덫이 될 수도 있다는 이야기다.
여기에 이른바 ‘입틀막법’의 징벌적 처벌 1호 대상으로 ‘김어준 방송’이 거론되는 상황도 결코 가볍지 않다. 민주당의 ‘상왕’으로 불려온 인물의 방송이 첫 표적이 될 수 있다는 사실 자체가 이 법의 성격을 적나라하게 보여준다. 결국 이재명 대통령의 사법 리스크를 덮기 위한 과속과 과잉 충성 경쟁이 자승자박의 결과를 낳고 있는 셈이다. 정치권의 충성 경쟁이 법과 제도를 망가뜨리는 전형적인 장면이다.

This is because the moment the judiciary is turned into a tool of power, democracy is left with nothing but a shell, and the rights of the people are stripped away like a skin. Yet, the ‘operation to drop indictments,’ which has been suspected as the primary purpose of this law, has hit a snag the moment it goes into effect. The situation is becoming even more complicated as suspicions regarding the so-called "deal to withdraw indictments" have surfaced.
There is an even greater irony. Criticism has begun to emerge from within the prosecution, the legal community, and even the Democratic Party that the newly created "crime of distorting the law" itself could serve as grounds to judge the act of withdrawing an indictment as "distorting the law." This implies that a law created for protection could become a trap that blocks that very protection.
Furthermore, the situation in which "Kim Ou-joon's broadcast" is being mentioned as the first target for punitive punishment under the so-called "silence law" is by no means trivial. The very fact that the broadcast of a figure known as the Democratic Party's "kingmaker" could become the first target starkly reveals the nature of this law.
