또한 권한 구조 변화에 대해서도 문제를 제기했다. 최 의원은 “대통령에서 행정안전부 장관, 경찰, 중수청으로 이어지는 단일 권력 라인이 형성될 수 있다”며, 권력이 한쪽으로 쏠릴 가능성을 경계했다.
특히 “이 법이 무너뜨리는 것은 검찰이 아니라 법 앞의 평등”이라며, “새로운 사법 질서가 아니라 특정 권력을 위한 성역이 될 수 있다”고 주장했다.
최 의원은 일부 사례를 언급하며 현행 수사 체계에서도 견제가 제대로 이루어지지 않았다고 비판했다.
그러면서 이번 개정안이 시행될 경우 부당 수사나 편파 수사에 대한 통제 장치가 더욱 약화될 수 있다고 강조했다.
