"정식으로 선관위에 안건을 상정해 결론이 난 것도 아닌데 사무처 직원들이 그렇게 이야기하는 건 월권 아닌가"
장제원 대통령 당선인 비서실장은 중앙선거관리위원회가 검수완박 법안에 대한 국민투표가 불가능하다는 입장을 밝힌 데 대해 쓴소리를 쏟아냈다.
장제원 비서실장은 28일 오전 서울 종로구 통의동 대통령직인수위원회 사무실 앞에서 기자들과 만나 "안건을 상정해 합의를 거친 것도 아닌데 일방적으로 그게 아니라고 이야기 할 수 있는 게 아니다"라고 지적했다.
그는 또한 '윤석열 당선인에게 사전에 검수완박 국민투표 방안을 보고했느냐'는 질문에는 "아직 하지 않았다. 우선 제일 중요한 건 국회에서 법적으로 보완하는 게 가장 빠르지 않겠나"라며 "문재인 대통령께서 국민이 원하지 않는 국회의원과 공직자들에게 불수사특권을 주는 법안에 대해 거부권을 행사하리라 생각한다"고 했다.
한편 헌법 72조에는 대통령이 필요하다고 인정할 때에는 외교·국방·통일 외에 기타 '국가안위'에 관한 중요정책을 국민투표에 붙일 수 있다고 돼 있다. 이를 근거로 윤 당선인 측에선 국민투표를 언급한 것으로 보인다.
하지만 중앙선관위는 검수완박 법안 국민투표와 관련 '현행 규정상으로는 투표인 명부 작성이 안 돼 국민투표는 불가능하다'는 입장을 밝힌 바 있다.
지난 2014년 헌법재판소에서도 재외국민의 투표권이 침해된다는 이유로 국민투표법에 대해 헌법불합치 결정을 내렸다. 결국 재외국민들도 투표에 참여할 수 있도록 법이 개정되지 않을 경우 국민투표를 치르긴 어려운 상황이다.
