브레이크뉴스 정명훈 기자= 이명박 전 대통령 부부가 서울 강남구 논현동 사저의 공매 처분을 취소해달라고 낸 행정소송에서 최종 패소했다. 결국 이 전 대통령의 사저는 공매 낙찰자에게 넘어가게 됐다.
23일 법조계에 따르면 대법원 3부(주심 노정희 대법관)는 지난 19일 이명박 전 대통령 부부가 한국자산관리공사(캠코)를 상대로 낸 공매 처분 무효확인 소송 상고심에서 심리불속행으로 기각하고, 원고 패소 판결한 원심을 확정했다.
심리불속행 기각은 위법 등 특별한 사유가 없어 심리도 하지 않고 상고를 받아들이지 않았다는 것이다.
앞서 검찰은 지난 2018년 4월 이명박 전 대통령을 뇌물 등 혐의로 기소 당시 자산 등에 대한 추징보전을 청구했고 법원이 이를 받아들여 논현동 사저를 동결 조치했다.
이후 대법원은 2020년 10월 이 전 대통령의 상고심에서 징역 17년에 벌금 130억원, 추징금 57억8000만원을 선고한 원심을 확정했다.
이에 따라 캠코는 이 전 대통령 소유의 논현동 소재 건물(599.93㎡)과 토지 1곳(673.4㎡)의 공매 대행을 검찰로부터 위임받아 매물로 내놨고, 지난해 7월 111억5600만원에 낙찰됐다. 해당 공매에는 응찰자 1명이 참가해 낙찰 받았으며 낙찰자 신원은 알려지지 않았다.
이후 이 전 대통령은 건물 지분을 부부가 2분의1씩 보유하고 있음에도 일괄해서 공매로 넘긴 것은 잘못됐다며 공매처분 무효 행정소송을 냈다. 하지만 1·2심에 이어 대법원마저 이들 주장을 받아들이지 않았다.
이 전 대통령 부부는 매각결정 취소 소송도 함께 냈는데, 지난해 11월 1심에서 패소했다. 2심은 오는 24일 항소심을 선고할 예정이었으나 추후 다시 기일을 잡기로 했다.
한편 이명박 전 대통령의 논현동 사저는 1978년 매입했으며 대지 673㎡, 건물 600㎡ 규모의 지하 1층, 지상 3층짜리 주택이다.
