야당은 다시 탄핵을 추진하고, 여당대표 한동훈은 죽각적인 대통령직무정지를 주장한다. 헌정의 위기는 점점 더 미궁 속으로 빠져들고 있다.
우선 한동훈의 대통령 직무정지 또는 직무배제 주장을 보자. 우리 헌법상 대통령의 직무배제는 탄핵소추가 되었을 때에만 가능하다.
건강 때문에 일시적으로 직무수행이 불가능한 경우, 국무총리 등이 직무를 대행하지만 이는 인위적 직무배제는 아니다. 사망하거나 사임하는 경우, 그 때는 직무가 종료된다는 것이지 정지되는 것이 아니다.
한동훈의 직무정지 주장은 헌법상 전혀 근거가 없다. 반(反)헌법적 주장으로 헌정의 위기를 더 이상 부채질하지 말아야 한다.
야당은 지난 토요일 부결된 탄핵안을 다시 제출한다. 회기가 바뀌었으니 일사부재의의 원칙에 위배되지 않는다고 한다. 그러나 같은 사유로 탄핵을 반복하는 것은 상식에 반한다. 이는 헌정의 위기를 가속화 할 뿐이다.
미국은 탄핵소추가 되더라도 대통령의 직무가 정지되지 않는다. 클린턴은 상원에서 탄핵재판이 진행되는 동안 직무를 수행했다. 그리고 탄핵이 기각되는 순간 미국은 다시 정상으로 복귀했다. 이것이 헌법에 의한 정치, 민주헌정의 본 모습이다.
우리는 오늘의 정치위기를 헌법의 틀 안에서 신속하게 해결해야 한다. 그래야 나라도 살고 국민도 평안해진다.
야당 주장대로 탄핵안이 가결되면 직무가 정지되고 총리가 직무를 대행한다. 그리고 헌재가 대통령의 헌법위반 여부를 판단한다. 기각이든 인용이든 결정이 나면, 정치위기는 거기에서 해소된다.
그런데 헌재의 판단 이전에 검찰 등 수사기관이 대통령의 헌법위반을 기정사실화하고 강제수사에 돌입한다. 심지어 현직 대통령을 출국금지 시킨다.
이는 정치위기를 헌법의 틀 안에서 정치적으로 해결하는 길을 원천봉쇄하는 폭거가 아닐 수 없다. 헌법의 최종 해석은 헌재가 한다. 헌재의 판단을 보고 수사를 하는 것이 정도(定道)임을 명심해야 한다.
대한민국은 입헌주의(立憲主義)의 나라다. 우리 모두 냉철한 이성으로 오늘의 정치위기를 헌법의 정신 아래 해결해야 한다.

The opposition party is resubmitting the impeachment motion that was rejected last Saturday. They say that since the session has changed, it does not violate the principle of double jeopardy. However, repeating impeachment for the same reason is against common sense. This will only accelerate the crisis of the constitution.
In the United States, even if impeachment is brought about, the president’s duties are not suspended. Clinton performed his duties while the impeachment trial was underway in the Senate. And the moment the impeachment was dismissed, the United States returned to normal. This is the true nature of politics under the constitution and democratic constitutional government.
We must quickly resolve today’s political crisis within the framework of the constitution. Only then will the country survive and the people be at peace.
If the impeachment bill is passed as the opposition party claims, the president’s duties will be suspended and the prime minister will act as his representative. Then, the Constitutional Court will determine whether the president violated the constitution. If the decision is made, whether it is rejected or accepted, the political crisis will be resolved there.
However, before the Constitutional Court’s decision, the prosecution and other investigative agencies take the president’s violation of the constitution as a fait accompli and begin a compulsory investigation. They even ban the incumbent president from leaving the country.

The final interpretation of the Constitution is made by the Constitutional Court.
