윤석열 대통령 측이 2일 고위공직자범죄수사처(공수처)의 체포·수색영장 집행을 불허해달라며 서울서부지법에 이의신청을 냈다.
윤 대통령 수사 변호인단·탄핵심판 대리인단 공보 역할을 맡은 윤갑근 변호사는 이날 "(작년) 12월 31일자 체포·수색 영장은 형사소송법·헌법에 반해 집행할 수 없으므로 집행을 불허한다는 재판을 구하는 것"이라고 전했다.
윤 대통령 측은 '검사의 구금·압수·압수물 환부에 관한 처분에 불복이 있으면 그 직무집행지 관할법원·검사의 소속검찰청에 대응한 법원에 그 처분 취소·변경을 청구할 수 있다'는 준항고 규정을 근거로 삼았다.
형사소송법상 체포영장 발부에 불복해 항고할 수 있는 '영장 항고' 제도가 없는 점 등을 고려해 재판에 대한 준항고 대신 공수처 검사의 체포 시도 자체를 문제 삼은 것이다.
