윤석열 대통령 측이 15일 고위공직자범죄수사처(공수처)의 불법체포를 주장하며 서울중앙지법에 체포적부심사를 청구했다.
윤 대통령 변호인단은 이날 윤 대통령 체포 후 공수처 첫 조사가 끝난 뒤 입장문을 통해 이같이 밝혔다. 체포영장을 발부한 서울서부지법 아닌 서울중앙지법에 청구한 것이다.
변호인단은 "수사권 없는 공수처는 관할권 없는 법원으로부터 발부받은 불법 체포영장으로 대통령 관저에 불법 침입해 기어이 대통령에 대한 체포를 감행했다"고 했다.
그러면서 "공수처가 기소권이 없고 사건을 이첩받는 서울중앙지검은 대응 법원 중앙지법에 기소하게 되므로 중앙지법이 전속 관할권을 가진다"고 덧붙였다.
향후 공수처가 구속영장 청구를 할 방침인 가운데 서부지법에서 구속 전 피의자 심문(영장실질심사)을 받는 것을 차단하고 체포 여부 정당성을 다퉈보겠다는 것으로 보인다.
