윤석열 대통령 헌법재판소 탄핵심판에 23일 증인으로 출석한 김용현 전 국방장관이 "국가비상입법기구 쪽지를 제가 작성했다"고 밝혔다. 윤석열 대통령도 이날 직접 출석한 가운데 첫 변론기일(1·21)에 이어 두 번째다.
김 전 장관은 이날 오후 2시 서울 종로구 헌재 대심판정에서 열린 윤 대통령 4차 변론기일에 출석해 '(비상입법기구 쪽지를) 누가 작성했느냐?'는 윤 대통령 법률대리인단 송진호 변호사 신문에 이같이 답했다.
그러면서 "(비상계엄 국무회의 당시) 최상목 재정부(현 기획재정부) 장관이 늦게 왔다"며 "제가 만나진 못해 실무자를 통해 전달했다"고 답했다.
비상입법기구 쪽지엔 예비비 확보·국회 보조금 차단·긴급재정 확보 방안 등이 담긴 것으로 전해졌다.
또 "(쪽지 내용은) 첫 번째 예비비 확보였다"며 "비상계엄이 발령되면 예상치 못한 예산소요가 나올 수 있다는 판단하에 기재부에 요청한 사항"이라고 했다.
이어 "국회를 통해 정치적 목적으로 지급되는 각종 보조·지원금이 있다"며 "이런 것들을 차단하란 취지였다"고 했다.
비상입법기구 관련 예산 편성 관련해선 "긴급재정 입법권을 시행하기 위해 수행할 조직이 필요하다"며 "기재부 내에 구성하면 예산이 추가로 들어간다"고 설명했다.
더불어 송 변호사가 '대통령께서 검토하고 지시해야 가능한 것으로 아이디어 차원에서 제시한것 뿐이죠?'라고 묻자 "그렇다"며 "평상시 대통령께서 (법안 통과가) 막혀있는 거 뚫는게 필요하지 않겠나 하는 말씀을 몇 번 들은 기억이 나 정리한 것"이라고 했다.
한편 헌재는 이날 12·3 비상계엄 사태 관련자들 수사기관 진술조서를 증거로 채택하고 중앙선거관리위원회 관련 국정원 기밀문서를 확보했다.
헌재는 또 또한 지난 2023년 7∼9월 국정원 선관위 보안점검 당시 재직했던 백종욱 전 국정원 제3차장을 증인으로 채택할지 여부를 오는 24일 평의에서 논의할 예정이다.
