20일 윤석열 대통령 헌법재판소 탄핵심판 10차 변론 증인심문에서 홍장원 전 국정원 제1차장은 "(비상계엄 당시 체포 대상자 메모 관련) 두 번째 메모는 불필요한 내용이 너무 많아 폐기했다"고 증언했다.

또 '검찰에 증거로 제출한 메모에 조해주·양정철이 있느냔'란 질문에 "11일 오후 검찰 조사를 받으면서 검사에게 메모를 설명하는 과정에서 조해주·양정철을 적어넣어 드렸다"고 했다.
