지성인들의 세속 참여는 일상적으로 있는 일이겠지만, 윤석열 대통령을 상식 선 이상으로 극렬하게 비방하거나, 국가의 사법기관(헌법재판소 재판관)에 있는 이들을 신(神)적 존재로 추앙케 하는 등의 편향된 논리를 꿰어 맞추며 상식(常識)을 허물어뜨리고 있다. 사법 절차에 띠라 수사와 재판이 진행되는 사건에 지성인이 과감하게 끼어들어, 과격(過激)한 발언들을 쏟아냈다.
김용옥 교수는 이 시국선언문에서 “지금 헌재 재판관 여덟 분은 단순한 사람이 아닙니다. 한 사람이 국가를 망하게 할 수도, 흥하게 할 수도 있다는 것은 상식을 벗어나는 일입니다. 오늘 이 시점에서 헌재 재판관 여덟 분은 사람이 아니라 신과 같은 존재입니다”면서 “사람의 권능을 벗어난 초월적인 힘을 부여받은 존재입니다. 이 신적인 재판관에게 좌도 없고, 우도 없고, 중도도 없습니다. 보수도 진보도 없으며, 어떠한 세속적 사감도 개입될 수 없습니다. 그들은 어두운 곳이든 밝은 곳이든 모든 곳에 빛을 비추는 햇빛과 같은 존재여야 합니다.”고 피력, 선언문을 접하는 이들을, 매우 어리둥절케 했다. 헌법 재판관이 신과 같은 존재라고 허풍(虛風을 떨고 있기 때문이다.
이어 윤석열 대통령을 언급하는 부분에서는 “윤석열은 내란의 수괴입니다. 이것은 저 개인의 판단이 아니라 역사적 사실이며, 민의의 판결이며, 민주적 절차를 통해 누구나 공감할 수 있는 사태로 드러난 사건입니다. 도덕적 포용의 대상이 될 수 없는 극악무도한 죄악입니다. 윤석열이 취임한 이후 오늘까지 저지른 언행은 불순한 사적 욕망, 거짓과 위선, 막가파식 독주, 이성을 거부하는 주술적 비합리성으로 점철되어 있습니다”고 설명하면서 “이 모든 언행의 바탕에는 헌정 질서를 거부하는 위헌적 권위의식이 지배하고 있습니다. 윤석열은 단군 이래 가장 악랄한 형태로 등장한 지도자상을 지니고 있으며, 민본과 민주를 거부하는 폐역(悖逆)의 존재입니다”라고, 못 박았다.

도올 김용옥 교수는 이 시국 선언문의 마지막 부분에서 “(윤석열 탄핵)기각은 단군 이래 조선 민중 역사 전체에 죄악의 씨를 뿌리는 것입니다. 그것은 국가의 파멸입니다.”고 단정(斷定)지었다. “(윤석열 탄핵)기각은 단군 이래 조선 민중 역사 전체에 죄악의 씨를 뿌리는 것”이라고 단언(斷言) 했다.
역사란 연륜(年輪)의 집적(集積)이다. 어찌 윤석열 대통령의 비상계엄 사태가 “단군 이래 조선 민중 역사 전체에 죄악의 씨를 뿌리는 것”이, 가능할까? 지나친-엄청난, 확대해석이 아닐까? 필자는 이렇게 읽었다.
그는 학자의 양식을 벗어나, 사회 혼란을 야기 시킬 수 있는 망상적 언어들을 나열했다. 언론인인 필자의 견해로는, 도올(김용옥 교수)은 제발 은인(隱人)-자중(自重) 했으면 한다.

지금 대한민국은 풍전등화와 같은 존망의 위기에 처해 있습니다. 이 땅 위에 존재하는 모든 사람에게 그러한 위기가 덮여 있습니다. 나는 이 땅을 사랑하고, 이 나라의 문화와 역사, 도덕과 장구한 질서의 가치를 존중하는 한 사람으로서 심중한 발언을 하지 않을 수 없습니다. 그러나 나는 이 말을 누구에게 해야 할지 모르겠습니다.
국민을 향해 외친다 한들, 국민 대부분은 내가 말하고자 하는 성명의 본질과 내용, 그 당위성을 이미 알고 있기에 나의 성명은 군소리가 될 수도 있습니다. 구체적으로 말하자면, 나의 성명은 윤 대통령 파면의 결정적 열쇠를 쥐고 있는 헌재 재판관 여덟 분을 향한 것입니다. 그러나 이 시점에서 헌재 재판관들에게 정신적 영향을 주기 위해 언설을 바라는 것은 영혼의 낭비이며, 바람직하지도 않고, 무엇보다도 그들에게 닿지 않을 것입니다.
