브레이크뉴스 정명훈 기자= 헌법재판소가 13일 최재해 감사원장에 대한 국회의 탄핵소추를 기각했다.
헌재는 이날 오전 최재해 감사원장에 대한 탄핵심판 선고를 열고, 재판관 만장일치 의견으로 탄핵소추를 기각했다.
헌재는 "감사원은 대통령실·관저 이전 결정 과정에서 관련 법령이 정한 절차를 준수했는지에 관한 감사를 실시했다"라며 "이 과정에서 부실 감사라고 볼 만한 다른 사정은 보이지 않는다"고 밝혔다.
전현희 전 국민권익위원장에 대해 '표적 감사'를 실시했다는 사유에 대해서도 "사퇴를 압박하기 위한 감사였다고 단정하기 어렵다"고 했다.
탄핵심판 결정의 효력은 즉시 발생함에 따라 최 원장은 직무정지된지 98일 만에 복귀하게 됐다.
한편, 최재해 원장에 대한 탄핵안은 지난해 12월 5일 더불어민주당 주도로 국회 본회의를 통과했다.
민주당은 최 원장이 대통령 집무실과 관저의 용산 이전에 대한 감사를 부실하게 했으며 전현희 전 위원장을 '표적 감사' 했다며 탄핵 사유가 발생했다고 주장했다.
