대장동 비리 사건 1심 판결에 대한 공판 검사들의 항소가 좌절되면서 여론이 들끓고 있다. 아울러 전국 18개 지청장들(검사장)을 비롯한 대검 연구관들, 심지어 노만석 검찰총장 대행의 핵심 참모진인 대검 부장(검사장)들까지 강하게 반발하고 나섰다.
이런 가운데 이인제 전 경기지사는 11일 자신의 페이스북을 통해 "대장동 항소포기사건의 전말이 드러나고 있다"며 "검찰 구성원 거의 모두가 거대한 저항의 대열에 합류하는 양상으로 가히 검란이다"는 의견을 남겼다.
이어 "노만석 대검차장은 법무부와 용산과의 관계를 고려해 포기를 지휘했다고 자백했다"며 "검찰이 정치집단인가! 권력에 빌붙어 검찰권 행사의 중립성을 팽개친 그는 당장 사퇴해야 한다"고 직격했다.
아울러 "법무부장관 정성호는 대검에 대하여 신중하게 판단하라는 의견을 개진했을 뿐이라고 말한다"며, 하지만 "대검으로부터 항소가 불가피하다는 보고를 받은 장관이 그런 말을 했으면, 그것이 곧 항소포기를 압박한 것이 아니고 무엇인가!"라고 되물었다.
그러면서 "법무장관은 개별사건에 대하여 수사지휘권을 행사할 수 있다"면서도 "그러나 합리적이고 합법적인 수사지휘일 때에만 정당성을 가질 수 있다"는 점을 분명히 했다. 따라서 "이 사건의 항소포기는 불합리하고 불법 그 자체다"고 질타했다.
또한 "정성호는 공식적인 수사지휘권 발동도 아닌 정치적 압박으로 검찰을 짓눌렀다"며 "그는 틈만나면 이재명에 대한 공소제기를 취소해야 한다고 말하는 사람"으로 "이 땅의 장관이 아니라 구름 위를 걷는 사람이다"고 힐난했다.
이에 "정성호는 당장 물러나고 직권남용 등 법적 책임을 감당해야 한다"며 "장관은 대통령의 참모이지 독단적으로 결정하는 자리가 아니다"고 지적했다. 더욱이 "7,000억 원이 넘는 범죄수익 환수를 포기하는 중대한 결정을 그가 독단으로 할 권한도 이유도 없다"고 덧붙였다.
이 전 지사는 이어 "그에게 그런 지시를 할 수 있는 사람은 한 사람 밖에 없다"며 "국민은 이제 그에게 책임을 물을 것이다"는 말로 사실상 이재명 대통령을 겨냥한 듯한 뉘앙스를 남기기도 했다.
