【브레이크뉴스 대구】진예솔 기자=3일 대구회생법원이 문을 열었다. 지난해 주호영 국회부의장이 대표 발의한 법 개정안이 시행된 데 따른 결과다. 수도권에 집중됐던 회생 전문 사법 기능이 대구에도 설치되면서, 지역 내 개인·법인 도산 사건 처리 지연이 해소되고 재기 지원도 한층 빨라질 것으로 기대된다.
이날 대구회생법원은 대구법원종합청사 신관 4층에서 개원식을 갖고 공식 업무에 들어갔다. 이번 개원은 2024년 ‘각급 법원의 설치와 관할구역에 관한 법률’ 일부개정법률안 시행으로 이뤄진 것이다.
법 개정으로 올해부터 대구·광주·대전에 회생법원이 신설됐다. 이에 따라 도산 전담 법원은 기존 서울·수원·부산을 포함해 전국 6곳으로 확대됐다. 대구회생법원 초대 법원장으로는 심현욱 울산지법 부장판사가 임명됐으며, 도산 사건을 전담할 전문 법관 9명이 배치됐다.
대구는 중소사업체가 많은 지역 특성상 개인회생 및 파산 사건이 유난히 많다. 지난해만 해도 대구에서 접수된 개인회생·파산 사건은 1만 6,471건으로 전국에서 두 번째 규모였다. 법인 도산 사건도 206건에 달했다. 하지만 그간 지방법원에서 사건을 처리하면서 개인회생 인가까지 평균 464일이 걸려, 전국 평균(298.4일)보다 지연됐다.
법조계에서는 회생법원 설치를 통해 사건 심리와 인가 절차가 전문화되면 처리 기간이 크게 단축될 것으로 보고 있다. 소상공인과 중소기업의 조기 재기뿐 아니라 채권 회수의 효율성도 높아질 것이라는 기대다.
대구회생법원은 당분간 연면적 1,332㎡의 임시 공간에서 운영된다. 법원은 달서구 이곡동 옛 식약처 건물(약 3,260㎡)을 리모델링해 단독 청사로 이전하는 방안을 추진 중이다. 이전 시점은 2027년 9월로 잡혔으며, 이후 사건 수요에 따라 인력과 시설 확충도 검토할 예정이다.

Sim Hyun-wook, a senior judge at the Ulsan District Court, was appointed as the first chief judge of the Daegu Rehabilitation Court, and nine specialized judges were assigned to handle bankruptcy cases.
Daegu, with its large concentration of small and medium-sized businesses, has seen a particularly high number of personal rehabilitation and bankruptcy cases. Last year alone, 16,471 personal rehabilitation and bankruptcy cases were filed in Daegu, the second-highest number nationwide. Corporate bankruptcy cases also reached 206. However, due to the district courts handling these cases, it took an average of 464 days for individual rehabilitation approval, compared to the national average of 298.4 days.
The legal community believes that the establishment of the rehabilitation court will significantly shorten the processing time by specializing the case review and approval process. This is expected to not only facilitate the early recovery of small business owners and SMEs, but also increase the efficiency of debt collection.
The Daegu Rehabilitation Court will temporarily operate in a temporary facility with a total floor area of 1,332 square meters. The court is currently pursuing a plan to relocate to a standalone building by remodeling the former Ministry of Food and Drug Safety building (approximately 3,260 square meters) in Igok-dong, Dalseo-gu. The previous date was set for September 2027, and expansion of personnel and facilities will be considered depending on the demand for future incidents.
