민생당 박정희 대변인은 13일 발표한 “NO 마스크, 누구나 잠재적 범법자 시민 자유 제한의 임계점을 지켜라”는 제목의 논평에서 “시민의 자유를 제한하는 데도 일정한 한계가 있다. 한계를 넘어서면 그 자체가 곧 침해”라고 설명했다.
이 논평을 통해 “문재인 정부는 코로나19 전염병 확산 방지를 명목으로 국민을 ‘잠재적 범죄자’로 만들 소지가 농후한 방침을 세웠다. 감염병의 예방 및 관리에 관한 법률을 개정하여 ‘2020년 11월 13일부터 23종의 중점, 일반관리시설을 대상으로 마스크 미착용자에 대하여 과태료 10만 원을 부과하겠다는 것”이라면서 “우리나라 대부분의 국민들은 코로나19 사태 대처를 위해 솔선하여 마스크를 착용하는 등 가장 어려운 길을 걷고 있다. 그런데 문정부는 감염병 예방을 위해 과태료 부과라는 가장 쉬운 방법을 선택했다”고 피력했다.
이어 “이는 국민의 기초적이고 기본적인 자유를 지나치게 도외시한 결정이다. 특히 일자리를 잃거나 소득이 반 토막 난 자영업자, 소상공인들은 자칫하면 과태료마저 내게 되었으니 한숨이 절로 날 수밖에 없다”고 강조하고 “시민의 자유를 제한할 때 반드시 임계점인 한계를 지키면서 국민의 생명과 안전을 지키는 것이 국가의 존재 이유다. 문정부의 과태료 결정에 아무런 고민의 흔적을 찾을 길이 없다는 것이 더욱 문제”라고 지적했다.
민생당은 “문재인 정부가 과태료를 부과함에 있어 극도로 신중한 접근을 해야 할 것이고, 과태료도 3만원 이내로 대폭 감축해야 하며, 이의제기 기간을 충분히 주고, 관련 소명자료에 대해 꼼꼼히 살펴서 억울한 국민이 생기지 않도록 만전을 기해야 할 것”을 촉구했다.

Keeping is the reason for the existence of the state. It is even more problematic that there is no way to find any traces of worries in the decision of the Moon Administration's fine.
The Minsaeng Party said, “The Moon Jae-in administration will have to take an extremely cautious approach in imposing a fine, and the fine should be drastically reduced to within 30,000 won. “You have to do everything right.”
