브레이크뉴스 정명훈 기자= 허경영 국가혁명당 명예대표가 지난해 제20대 대통령 선거 기간 "고(故) 이병철 삼성그룹 회장의 양자"라고 주장한 것과 관련, 1심에서 허위사실 유포에 따른 공직선거법 위반 혐의로 유죄를 선고받았다.
의정부지법 제13형사부(부장판사 박주영)는 25일 공직선거법 위반 혐의로 기소된 허경영 대표에게 징역 2년에 집행유예 3년을 선고했다.
재판부는 "피고인의 발언 내용은 허위사실이 인정된다"면서 "이 발언들은 대통령선거 과정에서 지지를 호소하며 이뤄진 점, 피고인의 가족 관계나 경력 등에 관한 것이 아니라 대통령 후보로서 과시하려는 목적이 인정된다"고 밝혔다.
이어 "이 사건은 공정한 판단에 영향을 미치는 선거의 공정성을 보장한다는 입법 취지를 몰각시켰고, 선거를 혼탁하게 하고 민주주의를 훼손시키는 중대한 범죄"라고 지적했다.
그러면서 "다만 피고인의 연령과 선거의 결과에 미친 영향이 미비했다는 점 등을 참작해 형을 정했다"고 판시했다.
한편, 허경영 대표는 지난해 제 20대 대통령 선거 기간에 자신이 이병철 전 회장의 양자라거나 고(故) 박정희 전 대통령의 정책보좌관이었다고 발언을 해 공직선거법 위반 혐의로 기소됐다.
