브레이크뉴스 정민우 기자= 군사 기밀을 뻬돌려 재판을 받고 있는 현대중공업 직원 A씨가 항소심에서 무죄였던 부분도 유죄로 판결났다.
부산고법 울산재판부 형사1부(재판장 손철우)는 30일 군사기밀보호법 위반 혐의로 기소된 A씨의 항소심에서 원심 무죄부분을 파기하고 징역 1년 6개월에 집행유예 3년을 선고했다.
A씨는 한국형 차기 구축함 등 특수선 사업 수주를 위해 2012년부터 2015년까지 군사 3급 기밀인 ‘장보고-Ⅲ(Batch-Ⅰ)’ 사업추진 기본전략 수정안 등을 수집한 뒤 사내 내부 서버에 올린 혐의로 기소됐다.
1심에서는 A씨가 군사기밀에 해당하는 사항을 불법적인 방법으로 수집한 혐의 등에 대해서는 유죄로 봤지만, 직접 기밀문서를 회사 서버에 올려 누설한 혐의에 대해서는 증거불충분으로 무죄로 판단했다.
하지만 검찰은 A씨가 직접 또는 다른 직원을 통해 사내 서버에 군사기밀에 해당하는 문서를 올리게 했다며, 공소장을 변경해 항소했다.
이에 재판부는 “군사기밀을 불법취득한 군사기밀과 현대중공업 내부 서버에 업로드 돼 있던 PDF 파일이 동일한 자료자료이고, 피고인 지시 없이 그러한 자료가 업로드될 가능성은 상정하기 어렵다”며 “피고인이 업로드 사실을 기억하지 못하는 것은 관행적으로 그렇게 해왔기 때문에 기억에 남지 않았을 개연성 크다고 판단” 유죄 판결 선고했다.
단, 형량은 기존과 동일하게 선고함 징역 1년 6월, 집행유예 3년이 선고됐다.
