윤석열 대통령 변호인단이 13일 '경찰의 체포영장 집행은 불법임에도 불구 영장 집행 시도 시 공무원 신분증 착용·제시 및 동일인 여부 확인을 위한 얼굴을 공개하라'고 요구했다.
윤 대통령 수사 변호인단·탄핵심판 대리인단 공보 역할을 맡은 윤갑근 변호사는 이날 낸 입장문에서 "고위공직자범죄수사처가 발부받은 영장은 불법·무효"라며 "경찰이 기어코 공수처 지휘에 따라 불법 영장 집행에 나선다면 최소한 법적 의무라도 지켜야 할 것"이라며 이같이 요구했다.
그러면서 "국가인권위원회는 경찰공무원에 직무수행 중 이해관계인 신분 확인 요구가 있을 경우 특별한 사정 없는 한 신분 확인에 응할 의무가 있다고 권고했다"며 "이는 폭도들이 경찰관을 가장해 국가 기밀시설에 침입하는 것을 막기 위해서도 꼭 필요한 조치"라고 지적했다.
또 "민생치안을 지켜야 할 일선 경찰들 마약범죄를 소탕해야 할 수사대까지 대통령 체포 작전에 투입하는 건 그 자체로 경찰 기본적 책무를 망각한 국민 배신행위"라며 "공수처 수사 지휘에 따를 의무 없는 경찰이 스스로 공수처 시녀가 돼 불법 집행 행동대원이 되는 우를 범하지 말라"고 강조했다.
