이번 세미나는 박균택 의원이 사단법인 한국군사법학회와 공동주최한 것으로 , 윤석열 정권 시기에 군이 연루된 대표적인 두 사건인 ‘채해병 순직사건 수사 외압’과 ‘12.3 비상계엄’ 에서 촉발되었던 ‘항명죄’ 를 법적으로 고찰해보고 개선 가능성까지 타진해보기 위해 개최되었다.
세미나의 발제는 김소연 전북대학교 법학전문대학원 교수가 진행했고, 토론자로는 최진호 대덕대학교 경찰행정학과 겸임교수, 선종수 동아대학교 법학연구소 연구교수, 권도형 국방부 군사법정책과장, 엄태문 변호사 등이 참여했다.
이날 세미나에서는 군형법상의 항명죄가 도출된 법적 배경과 항명죄의 구체적인 법적 구성요건을 살펴보고, 최근 12.3 비상계엄 당시의 부당하고 위법적인 명령에 대한 복종의무 인정 여부 등을 검토하며 변화하는 시대상에 따른 입법적 개선 가능성까지 종합적으로 논의하는 시간을 가졌다.
특히 토론 시간에는 한국군사법학회 회장인 이근우 가천대학교 법학과 교수를 비롯한 학회원 다수는 물론 현역 군법무관 등 현장 인력까지 개인 자격으로 참석해 항명죄의 해석과 향후 개선 입법 방향에 대한 열띤 의견 교환이 이뤄지기도 했다.
