더불어민주당 의원모임인 더 여민(대표: 안규백)은 오는 24일 오전 국회 의원회관 제1소회의실에서 "공직선거법 허위사실공표죄 상고심 절차의 쟁점과 과제"를 주제로 토론회를 개최한다.
이날 토론회는 이재명 전 더불어민주당 당대표의 공직선거법 사건을 배경으로 논의를 펼쳐갈 예정이다. 이 전 대표는 윤석열 정권의 폭압적 검찰권 행사로 수사 및 재판을 받아왔으나, 2024년 11월 25일 위증교사 1심 무죄, 2025년 3월 26일 공직선거법 항소심 무죄 등의 판결을 받은 바 있다.
이 가운데 공직선거법 사건은 검찰의 상고로 대법원에 계류돼 있는데, 언론 보도에 따르면 이르면 이번 주 중 주심 대법관을 배당하고 본격적인 심리에 돌입할 전망이다. 이와 관련하여 국민의힘 국회의원이나 극우 일각에서는 대법원이 유죄를 선고하는 상고심의 파기자판 혹은 이를 위한 전원합의체 회부를 해야 한다며 신속히 재판할 것을 주장하고 있다. 이는 정상적인 방법으로는 자력으로 대선에 승리하기 어려운 상황에서, 선거일인 6월 3일 이전에 이재명 전 대표에 대한 공직선거법 유죄판결을 확정함으로써 국민의 민주적인 절차에 따른 대통령 선출권을 박탈하고자 하는 것으로 보인다.
그러나 더 여민 포럼에 따르면, ▲ 사실심리를 하지 않는 법률심인 상고심의 경우 파기자판을 하는 것이 부적절한 점, ▲ 실제 2022년부터 2023년 사이 원심의 무죄판결을 뒤집어 대법원이 유죄로 파기자판을 한 사례는 단 한 건도 없는 점, ▲ 판례 변경의 필요성 등 전원합의체 회부의 요건에도 부합하지 않는 점 등을 고려하면, 이재명 전 당대표의 공직선거법 사건에 관한 극우 일각의 요구는 사법부에 대하여 법률과 사법 관습을 넘어 정치행위를 할 것을 요구하는 것과 같다. 특히 이재명 전 당대표는 윤석열 전 대통령 파면으로 치러질 6·3 대선에서 가장 유력한 후보로 손꼽히고 있는 만큼, 소송의 구조나 관행에 비추어볼 때 부적절한 주장임에도 불구하고 이재명 전 당대표에 대하여 신속한 재판을 요구하는 것은 사법부에 대한 부당한 정치적 압박이라는 것이다.
