브레이크뉴스 정명훈 기자= 이재명 더불어민주당 대선 후보의 '공직선거법 위반' 파기환송심이 대선인 6월 3일 이후로 연기됐다.
법조계에 따르면 서울고법 형사7부(부장판사 이재권)는 7일 이재명 후보의 공직선거법상 허위사실 공표 혐의 1차 공판기일을 당초 지정했던 5월 15일 오후 2시에서 대통령 선거 이후인 6월 18일 오전 10시로 연기했다.
서울고법은 연기 사유에 대해 "대통령 후보인 피고인에게 균등한 선거 운동의 기회를 보장하고 재판의 공정성 논란을 없애기 위해 재판 기일을 대통령 선거일 후로 변경했다"고 설명했다.
이어 "파기환송심 재판부는 법원 내 외부의 어떠한 영향이나 간섭을 받지 않고 오로지 헌법과 법률에 따라 독립해 공정하게 재판한다는 자세를 견지해왔고 앞으로도 마찬가지"라고 덧붙였다.
파기환송심 재판부가 대선 이후로 재판 일정을 연기함에 따라 이재명 후보의 대선 유세 일정에는 지장이 없을 것으로 보인다.
민주당 측에서도 법원의 이같은 결정에 환영의 입장을 전했다.
조승래 민주당 선거대책위원회 수석대변인은 서면 브리핑에서 "당연한 결정"이라며 "공정 선거를 위한 최소한의 조건이 갖춰졌다"며 "이제라도 법원이 국민 주권의 원칙과 상식에 맞는 판단을 내린 것은 다행"이라고 말했다.
조 수석대변인은 이어 "공직선거법 재판 외에도 여러 사건의 재판 기일이 잡혀 있다"며 "나머지 재판 역시 연기하는 것이 순리에 맞다"고 촉구했다.

Lee Jae-myung, the Democratic Party of Korea's presidential candidate, has been postponed to after June 3, the day of the presidential election, for his "violation of the Public Official Election Act."
According to the legal community, the 7th Criminal Division of the Seoul High Court (Presiding Judge Lee Jae-kwon) postponed the first trial date for Lee Jae-myung's false facts under the Public Official Election Act from 2:00 PM on May 15, originally scheduled for the day after the presidential election, to 10:00 AM on June 18.
The Seoul High Court explained the reason for the postponement, saying, "We changed the trial date to after the presidential election day in order to guarantee equal campaign opportunities for the defendant, who is a presidential candidate, and to eliminate controversy over the fairness of the trial."
He added, "The remand and retrial court has maintained the position of being independent and fair in its trials solely in accordance with the Constitution and the law, without any influence or interference from inside or outside the court, and it will continue to do so in the future."
As the remand and retrial court postponed the trial schedule until after the presidential election, it seems that there will be no disruption to candidate Lee Jae-myung's presidential campaign schedule.
The Democratic Party also welcomed the court's decision.
In a written briefing, Cho Seung-rae, the chief spokesperson for the Democratic Party's election campaign committee, said, "It is a natural decision," and "The minimum conditions for a fair election have been met," and "It is fortunate that the court has now made a judgment that is in line with the principle of popular sovereignty and common sense."
Chief Spokesperson Cho continued, "In addition to the Public Official Election Act trial, there are trial dates for several cases," and urged, "It is only natural to postpone the remaining trials as well."
