대구고법 형사1부(고법판사 정성욱)는 19일 특정범죄 가중처벌 등에 관한 법률 위반(뇌물) 등 혐의로 기소된 임종식 경북교육감 등 6명에 대한 항소심에서 원심 판결을 파기 하고 무죄를 선고했다.
재판부는 또 전직 경북도교육청 공무원 2명과 현직 경북지역 시의원 1명 등 피고인 3명에 대해서도 원심이 선고한 유죄 부분을 파기하고 모두 무죄를 선고했다.
재판부는 “이 사건 수사개시의 단서가 된 피고인 A씨의 휴대전화 전자정보는 위법수집증거에 해당해 증거능력이 없고 수사기관이 위 전자정보를 기초로 해 획득한 2차적 증거들도 모두 위법수집증거에 해당해 증거능력이 없다”며 “이들의 법정 진술이 위법수집증거가 아니라고 가정하더라도 그 진술 내용이 지나치게 개괄적이고 신빙성이 떨어져 검사가 제출한 증거들만으로는 공소사실을 유죄로 인정하기 어렵다”고 무죄 판단 이유를 밝혔다.
임 교육감은 지난 2018년 6월 제7회 교육감 선거 과정에서 경북교육청 소속 교직원들로 결성한 조직을 활용해 선거운동을 기획하고 선거 캠프 관계자들에게 선거운동 대가로 금전을 제공한 혐의로 재판에 넘겨졌다.
