[브레이크뉴스=배종태 기자] 국민의힘 김미애 의원(부산 해운대을, 보건복지위)이 여성의 현역병 복무 기회를 확대하는 내용의 병역법 일부개정법률안을 19일 대표 발의했다.
이번 개정안은 병역 자원의 급감에 따른 병력 공백 문제를 해소하고, 국방력 유지를 위한 제도적 기반을 마련하는 데 중점을 두고 있다.
최근 6년간 국군 병력은 11만 명이 줄어들었고, 정부가 설정한 2028년 상비병력 50만 명 유지 계획도 약 5만 명의 인력이 부족한 것으로 나타났다.
출생률 감소세가 계속되면서 향후 20년 내 병역 대상 남성이 연간 10만 명 수준으로 줄어들 수 있다는 우려도 제기된다. 특히 육군의 전투 병력 충원이 점점 어려워지고 있어 안보 공백을 막기 위한 특단의 조치가 필요한 시점이다.
현행 병역법상 여성도 지원을 통해 장교나 부사관으로 복무할 수는 있으나, 현실적으로 일반 현역병으로의 복무는 사실상 불가능한 구조였다.
김 의원이 발의한 이번 개정안은 병무청장과 각 군 참모총장이 현역병 선발 시 성별과 관계없이 지원자를 선발할 수 있도록 법적 근거를 마련하고 있다. 이를 통해 여성에게도 현역병 복무의 길을 제도적으로 열어주겠다는 것이다.
또한 개정안은 여성 현역병 복무가 본격화될 경우 발생할 수 있는 고충 및 제도적 문제를 체계적으로 관리하기 위한 장치도 포함하고 있다. 국방부 장관은 여성 현역병의 복무 실태, 고충 처리 현황, 제도 운영 성과 등을 매년 정기국회 개회 전까지 국회에 보고해야 한다.
김 의원은 “병력 자원 감소는 단기간에 해결하기 어려운 구조적 문제”라며 “성별에 관계없이 다양한 인재가 국방에 기여할 수 있도록 자발적인 복무 참여 기회를 넓히는 것이 필요하다”고 강조했다.
이번 개정안은 병역 제도의 성평등성을 높이고, 지속가능한 병력 운영 체계를 마련하기 위한 하나의 전환점이 될 전망이다.

On August 19, Rep. Kim Mi-ae of the People Power Party (Busan Haeundae B, member of the Health and Welfare Committee) proposed a partial amendment to the Military Service Act aimed at expanding opportunities for women to serve as active-duty soldiers.
The proposed amendment focuses on addressing the shortage of military personnel due to a sharp decline in conscription resources and establishing a legal framework to maintain national defense capabilities.
Over the past six years, the number of active-duty soldiers in the South Korean military has decreased by 110,000. The government’s plan to maintain 500,000 standing troops by 2028 is also projected to fall short by about 50,000 personnel.
With the ongoing decline in birth rates, it is feared that the annual number of male conscripts could decrease to around 100,000 within the next 20 years. In particular, it is becoming increasingly difficult to replenish combat forces in the Army, making it imperative to implement bold measures to prevent a security gap.
Under the current Military Service Act, women can serve as officers or non-commissioned officers through voluntary application, but in practice, they are not able to serve as general active-duty enlisted soldiers.
Rep. Kim’s proposed amendment would establish a legal basis for the Military Manpower Administration and the Chiefs of Staff of each branch to select active-duty soldiers regardless of gender. This would effectively open the door for women to serve as active-duty enlisted personnel.
The amendment also includes provisions to systematically manage any difficulties or institutional issues that may arise if women begin to serve in significant numbers. The Minister of National Defense would be required to report annually to the National Assembly—before the regular session begins—on the status of women's active-duty service, grievance handling, and the overall effectiveness of the system.
Rep. Kim stated, “The reduction in manpower resources is a structural problem that cannot be resolved in the short term,” emphasizing the need to “expand voluntary service opportunities so that individuals of all genders can contribute to national defense.”
This proposed amendment is expected to serve as a turning point for enhancing gender equality in the military service system and establishing a sustainable military manpower structure.
