【브레이크뉴스 대구】진예솔 기자=대구지법 제1행정부(재판장 정석원)가 19일 대구퀴어문화축제 조직위원회가 중부경찰서를 상대로 낸 ‘차로 제한 집행정지’ 가처분 신청을 기각하자, 정의당 대구시당이 강하게 반발했다.
재판부는 경찰이 축제 장소인 동성로 대중교통전용지구에서 1개 차로만 허용한 것에 대해 “과도한 집회 자유 제한으로 보기 어렵고, 공공복리에 적합하다”며 조직위 청구를 받아들이지 않았다. 또 “사회적 소수자들의 인권은 시대와 상황에 따라 변해왔으며, 퀴어축제도 2009년 이후 매년 열려 왔다”고 언급했다.
이에 정의당은 “성소수자 인권을 과거로 되돌리는 시대착오적 판단”이라고 비판했다.
이어 “헌법이 보장한 집회·시위의 자유를 외면하고, 지난해와 동일한 결정을 기계적으로 답습했다”며 “퀴어축제의 특수성을 전혀 고려하지 않은 판결”이라고 꼬집었다.
특히 법원의 “인권은 시대와 상황에 따라 변해왔다”는 발언에 대해 “성소수자들이 차별 속에서도 스스로 권리를 쟁취해온 성과를 왜곡한 것”이라고 반박했다.
정의당은 또 “집회·시위는 허가제가 아니라 신고제인데, 법원 결정은 집회 허가제를 정당화하는 위험한 발상”이라며 “향후 공권력이 집회 권리를 자의적으로 제한할 수 있는 빌미가 될 것”이라고 경고했다.
한편 축제 조직위는 법원 판단에 대비해 국채보상로 중앙네거리~공평네거리 600m 구간(2·28기념중앙공원 측 3차로)으로 장소를 변경해 경찰에 신고를 마쳤다.
하지만 축제를 반대하는 일부 종교단체와 상인들이 맞불 집회를 예고하면서 현장 혼잡과 충돌 가능성도 제기된다.
경찰은 대규모 인력을 투입해 안전관리에 나서고, 대구시도 상황 관리에 적극 협조할 방침이다.
정의당 대구시당은 “반인권적이고 반헌법적인 법원의 결정을 규탄한다”며 “제17회 대구퀴어문화축제가 평화롭고 안전하게 치러질 수 있도록 모든 소수자 인권을 위해 끝까지 연대하겠다”고 강조했다.
