이 사건은 대구시가 산하 및 공공기관에 대구MBC의 취재를 거부하라는 지시를 내렸다는 의혹으로, 대구경실련과 대구참여연대는 홍 전 시장을 직권남용권리행사방해 혐의로 고발했다.
법원은 이미 홍 전 시장의 지시로 대구시 공무원과 산하기관이 대구MBC의 취재를 사실상 차단했다는 점을 인정했다. 판결문에는 “대구시 공무원과 산하기관이 자율적 판단 없이 시장 지시에 따라 취재를 불허했다”며 “시청사, 소방서, 산하 공기업 및 출자출연기관 등에서 MBC의 취재가 전면 금지됐다”고 적시됐다.

이 같은 경찰의 부실수사는 최근 국정감사에서도 거듭 도마 위에 올랐다. 김정기 대구시장 권한대행은 “취재거부는 공보관을 통해 공식적으로 내려간 시의 지시였으며, 이는 개인 판단이 아니라 조직 결정이었다”고 말해 논란을 키웠다. 오히려 홍 전 시장의 지시 체계와 공적 책임을 스스로 인정한 셈이란 해석도 나온다.
