브레이크뉴스 정명훈 기자= 퇴직금과 성과급 명목으로 약 50억원을 수수한 혐의로 재판에 넘겨진 곽상도 전 국민의힘 의원의 아들 곽병채씨가 1심에서 무죄를 선고받았다.
서울중앙지법 형사합의23부(부장판사 오세용)는 6일 특정범죄 가중처벌 등에 관한 법률 위반, 뇌물 혐의로 기소된 곽병채씨에게 무죄를 선고했다.
아울러 범죄수익은닉규제법 위반 혐의 등으로 함께 기소된 곽 전 의원과 화천대유자산관리 대주주 김만배씨 사건에 대해서는 공소기각 결정을 내렸다. 다만 김씨의 알선수재 및 정치자금법 위반 방조 혐의는 유죄로 인정돼 벌금 500만원이 선고됐다.
재판부는 검찰이 1심 무죄 판결 이후 별건으로 곽 전 의원을 다시 기소한 데 대해 “사실상 동일 내용에 대해 1심 판단을 두 번 받게 한 실질적 불이익”이라며 공소권 남용을 지적했다. 재판부는 “검찰이 항소심 절차를 밟지 않고 또 다른 공소제기를 통해 사실상 두 번의 1심 판단을 받아 무죄를 뒤집으려 했다”고 밝혔다.
곽병채씨의 뇌물 혐의에 대해선 곽 전 의원과의 공모관계가 인정되지 않는다고 했다. 재판부는 곽 전 의원이 하나은행에 영향력을 행사하는 대가로 돈을 받기로 했다는 명시적·암묵적 합의를 입증할 증거가 없다고 판단했다.
재판부는 “검사가 제출한 증거만으로는 곽상도가 뇌물 수수 범행에 공모했다고 볼 수 없다”며 “곽병채가 곽상도의 의사 연락 하에 뇌물을 받았다고 볼 증거도 없다”고 밝혔다.
한편 김만배씨가 남욱 변호사 등에게 정치자금을 알선하거나 법인 자금으로 후원금을 낸 일부 혐의에 대해선 유죄로 봤다. 재판부는 “민주정치의 건전한 발전이라는 입법 취지를 훼손했다”면서도 기부 액수가 크지 않은 점을 고려해 벌금 500만원을 선고했다.
곽 전 의원은 선고 직후 “5년이라는 세월이 흘렀다”며 “잃어버린 명예와 모든 것을 어떻게 보상받아야 할지 답답하다”고 말했다. 그는 이어 “검찰이 돈의 성격과 경위를 충분히 조사하지 않은 채 기소했다”며 불만을 표했다.
곽 전 의원은 2021년 대장동 개발 과정에서 하나은행 컨소시엄 이탈 방지를 위한 청탁 대가로 약 25억원 상당의 뇌물을 수수하고, 이를 화천대유 직원이던 아들 곽병채씨가 퇴직금과 성과급을 가장해 은닉한 혐의로 기소됐다.
검찰은 당초 곽 전 의원에게 뇌물수수 혐의를 적용했으나 2023년 2월 1심에서 무죄가 나오자, 직접 수령자인 아들의 혐의를 입증한 뒤 같은 해 10월 범죄수익은닉규제법 위반 혐의로 추가 기소했다. 아들 곽병채씨에게는 뇌물 공모 혐의가 적용됐다.
지난해 11월 결심공판에서 검찰은 곽병채씨에게 징역 9년과 벌금 50억여원, 추징금 25억여원을 구형했고, 곽 전 의원에게는 징역 3년, 김씨에게는 징역 2년을 구형했다.
검찰은 이 자리에서 “대장동 개발 사업 관계자 중 누구도 곽병채와 같은 직급의 직원이 퇴직금과 위로금 명목으로 50억원을 받은 것을 찾을 수 없고, 일반적인 다른 사업에서도 전례가 없다”면서 “이것이 정당한 근로의 대가라고 국민을 설득하는 것 자체가 불가능하다”고 주장했다.
반면 곽병채씨는 최후진술에서 “4년 넘는 시간 동안 쌓인 오해를 풀기 위해 노력했다”며 “아버지의 개입은 없었다”고 호소했다.
Former Rep. Kwak Sang-do's Son Acquitted in First Trial for Accepting 5 Billion Won in Severance Pay
Kwak Byung-chae, the son of former People Power Party lawmaker Kwak Sang-do, who was indicted on charges of accepting approximately 5 billion won in severance pay and performance bonuses, was found not guilty in the first trial.
The 23rd Criminal Division of the Seoul Central District Court (Presiding Judge Oh Se-yong) found Kwak Byung-chae not guilty on the 6th of charges of violating the Act on the Aggravated Punishment, etc. of Specific Crimes and bribery.
Furthermore, the court dismissed the charges against former Rep. Kwak and Hwacheon Daeyu Asset Management's major shareholder Kim Man-bae, who were also indicted on charges of violating the Act on the Regulation of Concealment of Criminal Proceeds. However, Kim was found guilty of receiving bribes and aiding and abetting violations of the Political Funds Act, and was fined 5 million won.
The court criticized the prosecution's re-indictment of former lawmaker Kwak on a separate charge after the first trial's not-guilty verdict, stating that it "substantially disadvantaged the prosecution by subjecting the same matter to a second trial judgment," and that this constituted an abuse of prosecutorial power. The court noted, "The prosecution attempted to overturn the not-guilty verdict by filing another indictment without going through the appeals process, effectively obtaining two first trial judgments."
Regarding the bribery charges against Kwak Byung-chae, the court ruled that there was no evidence of a conspiracy between Kwak and the former lawmaker. The court found that there was no evidence to support an explicit or implicit agreement between Kwak and Hana Bank to receive money in exchange for his influence over the bank.
The court stated, "The evidence presented by the prosecution alone does not support the view that Kwak Sang-do conspired to commit bribery." "There is also no evidence to suggest that Kwak Byung-chae received the bribe under Kwak Sang-do's direction."
Meanwhile, Kim was found guilty of some charges, including arranging political funds for attorney Nam Wook and others and using corporate funds to make donations. The court, while stating that the donation "damaged the legislative intent of promoting the sound development of democracy," imposed a fine of 5 million won, considering the small amount of the donation.
Immediately after the sentencing, former lawmaker Kwak stated, "Five years have passed," and added, "I'm frustrated as to how I can compensate for my lost reputation and everything else." He continued, expressing his discontent, saying, "The prosecution indicted me without sufficiently investigating the nature and circumstances of the money."
Former lawmaker Kwak was indicted on charges of accepting approximately 2.5 billion won in bribes in 2021 in exchange for a favor to prevent the Hana Bank consortium from leaving during the Daejang-dong development project. His son, Kwak Byung-chae, then an employee at Hwacheon Daeyu, concealed the money by disguising it as severance pay and performance bonuses.
Prosecutors initially charged Kwak with bribery. However, after the first trial in February 2023 found him not guilty, prosecutors indicted him again in October of the same year on charges of violating the Act on the Control of Concealment of Criminal Proceeds after proving the charges against his son, the direct recipient. His son, Kwak Byung-chae, was charged with conspiracy to commit bribery.
At the final trial last November, prosecutors sought a nine-year prison sentence, a fine of approximately 5 billion won, and a surcharge of approximately 2.5 billion won for Kwak Byung-chae. They also sought a three-year prison sentence for former lawmaker Kwak and a two-year sentence for Kim.
Prosecutors argued, "No employee of Kwak Byung-chae's level in the Daejang-dong development project received 5 billion won in severance pay and severance pay, and this is unprecedented in other projects." They added, "Convincing the public that this is legitimate compensation for hard work is impossible."
In contrast, Kwak Byung-chae pleaded in his final statement, "I have worked to resolve the misunderstanding that has built up over four years," and "My father was not involved."
