이날 상병헌 세종시의회 의장은 토론자로 나서 "현행 지방자치법상 지방자치단체(장)에 지나치게 권한이 집중돼 있다"며 "지방의회가 독립기관으로서 제 역할을 할 수 있도록 적극적인 제도 개선이 필요하다"고 강조했다.
상 의장은 지방자치법에서 지방자치단체장에 부여된 재의요구권과 관련해 “국가예산제도는 ‘예산의결주의’에 입각해 국회 본회의 의결과 동시에 예산으로 성립돼 대통령의 거부권이 인정되지 않는다"며 "이처럼 예산에 대한 지방자치단체장의 재의요구권을 폐지하는 것이 필요하다”고 제시했다.
또 “예산에 대한 재의요구는 1995년 전국동시지방선거 이전 관선 지방자치단체장과 민선 지방의원이 공존하던 과도기에 의회에 대한 강력한 견제 수단으로 도입된 것”이라며 “지방의회의 예산심의권을 제약하고 예산 불확정 등에 따른 주민 복리를 저해할 가능성이 있다”고 지적했다.
상 의장은 “국회법과 달리 지방의회가 도입된 지 30년이 넘도록 전국 243개 지방의회와 3,860명의 지방의원을 규율하는 독립된 법률이 없다" 며 "지방의회의 조직권, 예산편성권 등을 반영한 ‘지방의회법’ 제정이 그 어느 때보다 절실한 시점”이라고 역설했다.
