브레이크뉴스 정민우 기자= 엔씨소프트는 22일 서울중앙지방법원에 ㈜카카오게임즈와 ㈜레드랩게임즈를 상대로 저작권 침해 및 부정경쟁행위에 대한 소장(민사)을 접수했다고 밝혔다. 같은 날 대만 지혜재산및상업법원에도 저작권법 및 공평교역법 위반에 대한 소장(민사)을 접수했다.
엔씨소프트는 “카카오게임즈가 퍼블리싱하고, 레드랩게임즈가 개발한 롬(ROM)이 당사의 대표작인 ‘리니지W’의 콘텐츠와 시스템을 다수 모방한 사실을 확인했다”고 지적했다.
롬의 △게임 콘셉트 △주요 콘텐츠 △아트 △UI(사용자 인터페이스) △연출 등에서 리니지W의 종합적인 시스템(게임 구성 요소의 선택, 배열, 조합 등)을 무단 도용했다는 설명했다.
이는 MMORPG 장르가 갖는 공통적, 일반적 특성을 벗어나 창작성을 인정하기 어려운 수준으로, 엔씨의 지식재산권(IP)을 무단 도용하고 표절한 것이라 엔씨는 판단했다.
엔씨소프트는 “지난해 카카오게임즈가 출시한 ‘아키에이지 워’에서도 ‘리니지2M’의 콘텐츠와 시스템을 다수 모방한 사실을 확인하고 저작권 침해 및 부정경쟁행위에 대한 소송을 제기한 바 있다”며 “반복되는 콘텐츠 무단 도용과 표절에 깊은 우려를 표한다”고 전했다.
이어 “2023년 8월에는 웹젠 ‘R2M’의 ‘리니지M’ 표절 소송(서울중앙지방법원 2021가합543715)에서 승소하며, 기업의 핵심 자산인 지식재산권(IP)과 게임 콘텐츠의 성과물 도용에 대한 불법 행위를 법적으로 인정받았다”며 “이번 법적 대응은 엔씨소프트가 소유한 지식재산권(IP) 보호를 넘어 대한민국 게임산업의 경쟁력 강화를 위해 필요한 조치다. 엔씨소프트는 앞으로도 지식재산권(IP) 보호를 위한 노력과 대응을 지속하겠다”고 덧붙였다.
