브레이크뉴스 정명훈 기자= 지난 대선을 앞두고 유력한 대선주자였던 이재명 더불어민주당 대표의 측근에게 20억원대 돈다발을 전달했다고 주장한 '국제마피아파' 박철민씨가 1심에서 실형을 선고받았다.
수원지법 형사12부(황인성 부장판사)는 9일 공직선거법 위반 혐의로 기소된 박씨에게 징역 1년6개월을 선고했다.
재판부는 박씨가 허위사실임을 인식하고도 이를 공표해 이재명 대표의 명예를 훼손시켰다고 판단했다.
재판부는 "피고인이 대통령 선과와 관련해 유권자들의 선택을 호도했다"면서 "피고인의 주장은 일관되지 않거나 모순됐으며 뇌물 총액 20억원에 대한 특정한 근거가 전혀 없는 점 등을 고려하면 피고인이 공표 적시한 사실은 허위라는 것을 인정할 수 있다"고 판시했다.
이어 "우리나라의 앞으로 나아갈 방향을 결정하는데 극도로 중요한 대통령 선거와 관련해 돈다발 사진과 같은 자극적인 수단을 이용해 전파 가능성이 매우 큰 방법으로 범행을 저질렀다"면서 "이재명 대표는 당선이 유력한 대통령 후보자 중 한 명이었기에, 피고인이 공표·적시한 사실은 국민적 관심거리가 됐고 이에 따라 그의 명예가 침해됐다"고 설명했다.
한편, 장영하 변호사는 같은 해 10월 박씨의 말을 토대로 이 대표가 국제마피아 측근들에게 사업 특혜를 주는 조건으로 돈을 받았다는 이야기를 김용판 국민의힘 의원에게 전달했다.
김용판 의원은 이 내용을 경기도 국정감사장에서 공개하면서 논란이 시작됐다. 당시 국감장에선 장 변호사가 받았다는 현금다발 사진 등도 공개했는데, 이는 박철민씨가 렌터카와 사채업 홍보를 위한 촬영한 사진임이 뒤늦게 드러났다.
이에 민주당은 박씨와 장 변호사가 이 대표의 당선을 막을 목적으로 허위 사실을 공표했다며 공직선거법 위반 등 혐의로 검찰에 고발하며 수사가 시작됐다.
