고양특례시는 지난 2019년~2020년 민선7기에서 당초 확정했던 신청사 부지를 주교동 공영주차장 인근 부지로 변경하는 과정에서 정식 입지선정위원회 의결의 변경절차를 거치지 않고 소수 관계자의 결정으로 당초와 다른 부지로 변경하는 등 시 자체 특정감사 결과, 행정절차상 위법·부당 사항이 확인됐다고 밝혔다.
시는 28일 2019년~2020년 당시 주교동 공영주자창 인근 ‘고양시 신청사 입지선정’에 대한 특정감사 결과로 ▲고양시 신청사 선정부지 변경 조례 위반 ▲입지선정위원회 시민대표 선정 부적정 ▲입지선정위원회 위촉직 위원 구성 부적정 등 총 3건의 위법ㆍ부당 사항이 확인됐다고 전했다.
신청사 부지 위치·면적 변경에도 입지선정위원회 미개최
이번 감사는 고양시 신청사 입지선정 과정의 각종 의혹에 대한 시민단체들의 특정감사 요구가 지난 4월과 5월에 민원접수되어 진행된 것으로, 입지선정 과정의 적정성, 관련 행정절차 추진사항을 점검하여 각종 의혹을 해소하고 제도적 문제점을 도출ㆍ개선하고자 실시됐다.
현 고양시 청사는 지난 1983년 건립 이후 사무공간 협소 등으로 인한 행정수요의 효율적 처리 한계와 청사 노후에 따른 안전문제 등으로 신청사 건립 필요성이 대두됐다.
이에 시는 2018년 4월 6일 ‘고양시 신청사 건립 기본계획 용역’을 착수해 같은 해 12월 21일 용역 결과를 토대로 신청사 후보지 5곳을 선정했다.
이듬해인 2019년 6월 7일 ‘고양시 신청사 입지선정위원회 설치 및 운영에 관한 조례’를 제정한 뒤 같은 해 8월 6일 입지선정위원회 구성을 완료했다.
입지선정위원회 위원은 위원장인 당시 고양시 제1부시장, 시의원 3명, 전문가 5명, 시민대표 4명, 공무원 4명 등 총 17명으로 구성됐다.
이후 고양시는 2019년 8월 26일부터 총 9차에 걸쳐 입지선정위원회 회의를 개최했다.
2020년 5월 8일 9차 회의 의결을 통해 ‘고양시 주교동 공영주차장 부지 일원’을 고양시 신청사 부지로 선정했다.
그러나 2년 동안의 노력으로 준비했던 신청사 부지는 의결된 지 불과 한 달여 만인 2020년 6월 18일에 소수인원만 참석한 간담회를 개최하고 별도 ‘입지선정위원회’ 의결 없이 변경된 것이 확인됐다.
당시 고양시장 등과 용역업체만 참석한 ‘신청사 부지 경계 관련 간담회’에서 변경 결정한 전체 사업부지 7만3,096㎡ 중 입지선정위원회가 당초 의결한 주교동 공영주차장 부지와 중복되는 면적은 12,847㎡로서 80% 이상이 당초 부지가 아닌 인근 부지로 변경 결정됐다.
변경으로 인해 사유지 면적은 6,369㎡에서 5만2,888.95㎡로 4만6,519.95㎡만큼 증가되었다.
또한 당초 의결된 부지는 주교동 공영주차장 부지 일원(2만6,094㎡)을 본관으로 운영하고 기존 청사(1만4,032㎡)는 별관으로 운영하도록 계획해 4만126㎡로 검토했으나,
변경된 부지는 7만3,096㎡ 외에 기존 청사에도 4개 산하기관을 입주토록 계획해 실제 신축되는 부지 면적은 4만7,002㎡ 증가했으며, 심지어 청사공간은 당초 의결된 부지인 주교동 제1공영주차장 부지가 아닌 대장천 아래쪽(남쪽) 추가 확장된 공간만으로 계획하는 등 중대한 변경사항이 발생했지만 신청사 예정지로 결정하면서도 입지선정위원회의 변경 심의·의결 절차는 없었다.

이어 같은 해 8월 10일 행정안전부에 신청사 건립사업의 타당성 조사를 신청해 적정성 검토를 완료했다.
이처럼 신청사 부지 변경·결정은 ‘신청사 입지선정에 관한 사항’ 등의 안건이 발생할 때마다 위원회를 구성해 운영하도록 한 「고양시 신청사 입지선정위원회 설치 및 운영에 관한 조례」 제2조 및 제3조 제4항을 위반했고, 전 고양시장 등과 용역업체만이 검토해 결정했다.
특정·영리단체로 신청사 입지선정위원 구성
또한 입지선정위원회 구성 시 시민대표 선정도 부적정한 것으로 드러났다.
입지선정위원회 위원은 조례 제3조 제3항 제3호에 따라 시민단체, 협회 등 관련분야에 전문성이 인정되는 민간단체의 대표를 시민대표로 위촉하도록 되어 있다. 시
는 ‘입지선정위원회 구성계획’을 통해 비영리민간단체 등의 추천을 통해 고양시 지역별 대표성이 있는 단체ㆍ기관의 대표 등을 선정하기로 계획했다.

「양성평등기본법」 제21조 제2항과 「고양시 각종 위원회 구성 및 운영에 관한 조례」 제8조 제2항, 「고양시 성평등 기본 조례」 제12조에 따르면 위원회를 구성할 때 특정성별이 위촉직 위원 수의 6/10을 넘지 못하도록 되어 있다.
하지만 입지선정위원회 구성 시 위촉직 위원 12명 중 남성을 10명으로 선정해 법과 조례를 위반했다.
시는 지난 6월 1일부터 8주간 관련 서류를 검토하고 담당자 면담 및 확인서 징구 등을 통해 업무처리의 적정 여부를 확인ㆍ검증하는 감사를 실시하고, 이날 감사 결과를 발표했다.
시는 이번 감사를 통해 확인된 총 3건의 위법ㆍ부당사항에 대해 해당사항이 재발하지 않도록 주의요구를 내렸다.
